Welcome to Donna Stewart Art! These Terms of Service (“Terms”) describe how we provide our art products and services and the rules that apply when you make a purchase through our online store. This website is operated by Donna Stewart Art, a sole proprietorship based in California. Throughout the site, the terms “we”, “us” and “our” refer to Donna Stewart Art. We offer this website, including all information, tools, and services available from this site to you, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.
2. Online Store Terms
By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence. You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction.
3. Products and Services
Donna Stewart Art offers original physical artwork and custom art commissions. All artwork is created and sold by Donna Stewart. Prices and product descriptions are subject to change at any time without notice.
4. Orders and Payments
All payments are processed securely through Shopify Payments, which may include major credit cards, PayPal, Apple Pay, and other accepted payment methods. We reserve the right to refuse any order for any reason, including suspected fraud or misuse.
5. Custom Commissions
Custom commissions may require a non-refundable deposit before work begins. Once a commission is accepted and started, deposits are non-refundable. The remaining balance, if any, must be paid before final delivery or shipment.
6. Shipping and Delivery
We currently ship only within the United States. Orders typically ship via FedEx Ground or another comparable carrier. Shipping costs and delivery times vary by location. Standard shipping is included unless you select and pay for expedited delivery. We are not responsible for carrier delays, weather interruptions, or other circumstances beyond our control.
7. Returns and Refunds
All sales are final. We do not accept returns, exchanges, or cancellations once an order has been placed, except in cases where the item arrives damaged during shipping. If your artwork is damaged, please contact us within seven (7) days of receipt with photos and order details so we can assist in arranging a replacement or refund where appropriate.
8. Intellectual Property
All artwork, designs, images, and content on this website are the exclusive property of Donna Stewart Art and are protected by copyright and intellectual property laws. Purchase of an artwork does not transfer copyright ownership. Buyers may not reproduce, resell, distribute, or use any artwork or image for commercial purposes without prior written permission.
9. Accuracy of Information
We strive to provide accurate product images and descriptions, but colors and details may vary slightly due to differences in monitors or lighting. We are not responsible for such variations.
10. Limitation of Liability
To the fullest extent permitted by law, Donna Stewart Art shall not be liable for any indirect, incidental, or consequential damages arising from your use of our site or products. Our total liability shall not exceed the purchase price of the product in question.
11. Governing Law
These Terms and any separate agreements under which we provide you services shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
